I. Identification of the Website Controllers

This website https://gestexlink.com (hereinafter, the "Platform") is jointly operated by the following entities, each with distinct responsibilities:

GESTEXLINK is a legaltech technology marketplace whose purpose is to connect individuals and legal entities with qualified legal professionals. The Platform is not limited to immigration law, but covers all branches of the legal system, including among others:

• Corporate and Commercial Law
• Tax Law
• Employment and Social Security Law
• Civil and Family Law
• Intellectual and Industrial Property
• Immigration Law
• Administrative Law
• Data Protection and Digital Law

NexLink Hub S.L.U. acts exclusively as the technical operator of the Platform, without providing legal services or legal advice. Legal services are provided by GESTEXPERT S.L. or other registered professionals linked to the Platform.

III. Terms of Use

Access to and use of the Platform implies full and unreserved acceptance of these terms. NexLink Hub S.L.U. and GESTEXPERT S.L. reserve the right to unilaterally modify these terms at any time, without prejudice to obligations already incurred.

3.1 Permitted Use

The user undertakes to use the Platform in accordance with applicable legislation, ethics, generally accepted standards of conduct and this Legal Notice. Use of the Platform for unlawful purposes or purposes contrary to those set out herein is expressly prohibited.

3.2 User Liability

The user shall be liable for any damages of any kind that the Platform controllers may suffer as a result of breach of any of the obligations to which they are subject under these terms.

IV. Intellectual and Industrial Property

The contents of the Platform, including but not limited to: texts, photographs, graphics, images, icons, technology, software, source code, trademarks, logos, trade names, structure and visual design, are owned by NexLink Hub S.L.U. and/or GESTEXPERT S.L., or the corresponding licences are held for their use.

Total or partial reproduction, public communication, distribution, transformation or any other act of exploitation of such content without the express written authorisation of the rights holders is prohibited.

The GESTEXLINK brand and its logo are distinctive signs of NexLink Hub S.L.U. and GESTEXPERT S.L. Unauthorised use may constitute infringement of industrial property rights protected by applicable law.

V. Disclaimer of Warranties and Liability

NexLink Hub S.L.U. shall not be liable, under any circumstances, for damages of any kind that may arise from use of the services and contents of the Platform, including temporary unavailability due to maintenance, updates or force majeure.

Legal services are provided independently by GESTEXPERT S.L. as a separate legal entity with full legal capacity. NexLink Hub S.L.U. is not responsible for advice, opinions or legal views issued by professionals linked to the Platform.

VI. Applicable Law and Jurisdiction

These terms are governed by and construed in accordance with Spanish law. For the resolution of disputes arising from use of the Platform, the parties submit to the jurisdiction of the courts of Spain, with express waiver of any other forum that may apply.

In particular, the following apply:

• Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE).
• Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
• Organic Law 3/2018 of 5 December on Personal Data Protection and guarantee of digital rights (LOPDGDD).
• Royal Legislative Decree 1/2007 of 16 November approving the Consolidated Text of the General Law for the Defence of Consumers and Users.
• Law 7/1998 of 13 April on general contracting terms.
